These Terms govern the provision of website-building services by Ariel Yosupov ("the Service Provider") to clients ("the Client"). Contacting the Service Provider, approving a quote, or the actual start of work constitutes agreement to these Terms.
Services include, among others, building landing pages, business websites and online stores. The exact scope of work — including page count, features and content — is defined with the Client at the start of each project and confirmed in writing (message, email or a quote document).
Work is carried out in stages (discovery, planning and design, development, launch), as detailed on the "Process" page of the site. Each stage requires Client approval before moving to the next. Delays in approvals or in the Client supplying content may extend the estimated delivery times.
Payment is generally made in two stages: a deposit at the start of work, and the remaining balance at project completion and before the site is published or source files are handed over. Amounts and payment milestones are set in advance for each project.
The delivery times listed on the site (e.g. landing page within 2 days, business website within a week, online store within 2 weeks) are estimates under normal conditions, and depend on project scope and the Client's availability for content and approvals. An exact delivery time is set at the start of each project.
Upon full payment for the project, usage rights to the website — including design files, code and content created specifically for the Client — transfer to the Client. Third-party components (fonts, open-source libraries, stock images) remain subject to their own licenses.
The Service Provider does not guarantee and is not responsible for revenue, customers, sales, search engine rankings, or any other business outcome resulting from use of the website. A quality website is an important marketing tool, but its business success depends on many factors outside the Service Provider's control — such as target market, competition, marketing budget, the ongoing quality of content, and the business's own customer service. Nothing in the website or accompanying services constitutes a promise of any business result.
Changes or additions not included in the originally agreed scope (such as extra pages, special features, or revision rounds beyond what was agreed) may involve an additional cost, to be agreed with the Client before being carried out.
The service is provided "as is." The Service Provider is not liable for indirect, consequential damages or loss of profit of any kind. The Service Provider's total liability in any case shall not exceed the amount actually paid for the relevant project.
To the extent the website is hosted with a hosting provider, or uses a domain, email service or other third-party services (such as Google Fonts, WhatsApp), their availability and proper function are not the responsibility of the Service Provider.
The Service Provider may update these Terms from time to time. The version in effect is the one published on the site at the time of engagement with the Client.
